{"id":332,"date":"2019-12-26T14:20:25","date_gmt":"2019-12-26T13:20:25","guid":{"rendered":"https:\/\/lea-doukhan-avocat.fr\/?p=332"},"modified":"2019-12-26T14:20:26","modified_gmt":"2019-12-26T13:20:26","slug":"lobligation-de-jouissance-paisible-du-bailleur","status":"publish","type":"post","link":"https:\/\/lea-doukhan-avocat.fr\/index.php\/2019\/12\/26\/lobligation-de-jouissance-paisible-du-bailleur\/","title":{"rendered":"L\u2019OBLIGATION DE JOUISSANCE PAISIBLE DU BAILLEUR"},"content":{"rendered":"\n<p>Aux termes de l\u2019article 1719 du Code Civil, qui consacre les obligations \u00e0 la charge du propri\u00e9taire-bailleur, le bailleur est oblig\u00e9, sans qu\u2019il soit n\u00e9cessaire d\u2019ins\u00e9rer une stipulation particuli\u00e8re dans le contrat de bail, notamment&nbsp;:&nbsp;<\/p>\n\n\n\n<p>&nbsp;1\u00b0 De d\u00e9livrer au preneur la chose lou\u00e9e et, s\u2019il s\u2019agit de son habitation principale, un logement d\u00e9cent.&nbsp;<\/p>\n\n\n\n<p>2\u00b0 D\u2019entretenir cette chose en \u00e9tat de servir \u00e0 l\u2019usage pour lequel elle a \u00e9t\u00e9 lou\u00e9e&nbsp;;<\/p>\n\n\n\n<p><strong>3\u00b0 D\u2019en faire jouir paisiblement le preneur pendant la dur\u00e9e du bail&nbsp;;<\/strong><\/p>\n\n\n\n<p>Ces obligations protectrices du locataire sont d\u2019ordre public, ce qui signifie qu\u2019il n\u2019est pas possible d\u2019y d\u00e9roger dans le contrat. Toute clause de nature \u00e0 exon\u00e9rer le bailleur de ces obligations sera par cons\u00e9quent r\u00e9put\u00e9e non-\u00e9crite et ne produira aucun effet.&nbsp;<\/p>\n\n\n\n<p><em>Qu\u2019implique donc cette derni\u00e8re obligation du bailleur qui consiste \u00e0 permettre au locataire de jouir paisiblement de son local pendant la dur\u00e9e du bail&nbsp;?&nbsp;<\/em><\/p>\n\n\n\n<p>Il incombe au bailleur de pr\u00e9server le locataire de tous les troubles de fait et de droit qui pourraient lui causer un pr\u00e9judice de jouissance.&nbsp;<\/p>\n\n\n\n<p>Le trouble de fait correspond \u00e0 une action commise par une ou plusieurs personnes qui emp\u00eachent le locataire d\u2019user paisiblement, c\u2019est-\u00e0-dire sans \u00eatre perturb\u00e9 dans son activit\u00e9, du local qu\u2019il a lou\u00e9.&nbsp;<\/p>\n\n\n\n<p>Ces troubles, comme par exemple des travaux rendant difficile l\u2019usage des lieux, des visites du local sans autorisation du locataire, peuvent \u00eatre le fait du bailleur lui-m\u00eame ou de tiers.<\/p>\n\n\n\n<p>Pr\u00e9alablement \u00e0 la remise des cl\u00e9s au preneur, le propri\u00e9taire doit par ailleurs s\u2019assurer que l\u2019ensemble des \u00e9quipements collectifs de l\u2019immeuble (eau, \u00e9lectricit\u00e9, chauffage) sont en \u00e9tat de marche.<\/p>\n\n\n\n<p>Sauf exception, le bailleur ne pourra \u00eatre tenu responsable des troubles du fait des tiers. Il devra toutefois pouvoir justifier avoir effectu\u00e9 l\u2019ensemble des diligences n\u00e9cessaires \u00e0 la cessation de ce trouble.&nbsp;<\/p>\n\n\n\n<p>Le trouble de droit correspond \u00e0 la revendication par un tiers d\u2019un droit sur le local lou\u00e9, comme par exemple la revendication d\u2019un droit de passage ou servitude, ou d\u2019un droit de propri\u00e9t\u00e9 ou de jouissance sur le bien lou\u00e9.<\/p>\n\n\n\n<p>Bien \u00e9videmment, cette revendication aura pour effet de contrarier la jouissance paisible du locataire, ce dont le bailleur sera n\u00e9cessairement responsable.&nbsp;<\/p>\n\n\n\n<p>Le pr\u00e9judice subi par le locataire pour ces troubles est en g\u00e9n\u00e9ral indemnis\u00e9 par des dommages et int\u00e9r\u00eats, mais le propri\u00e9taire-bailleur peut \u00e9galement \u00eatre condamn\u00e9 \u00e0 prendre certaines mesures pour les faire cesser.&nbsp;<\/p>\n\n\n\n<p>Parfois, la r\u00e9siliation du bail aux torts du
