En signant un contrat avec le sous-locataire, le locataire devient par essence, son bailleur.&nbsp;<\/p>\n\n\n\n<p>Le Code de commerce r\u00e9git en son&nbsp;<strong>article L.145-31<\/strong>&nbsp;les r\u00e8gles qui gouvernent&nbsp;<strong>la sous-location de bail commercial<\/strong>&nbsp;: le principe, \u00e9nonc\u00e9 \u00e0 l\u2019alin\u00e9a 1<sup>er<\/sup>&nbsp;du dit article pr\u00e9voit l\u2019interdiction de la sous-location, cependant l\u2019alin\u00e9a 2 de l\u2019article L.145-31 pr\u00e9voit quant \u00e0 lui un r\u00e9gime d\u00e9rogatoire, sous respect de certaines conditions.&nbsp;<\/p>\n\n\n\n<p>Ainsi, pour que la sous- location de bail commercial soit qualifi\u00e9e de l\u00e9gale, le bailleur doit, d\u2019une part, donner son autorisation au locataire, par \u00e9crit, et d\u2019autre part, doit \u00eatre invit\u00e9 \u00e0 concourir \u00e0 l\u2019acte. Concr\u00e8tement, selon l\u2019article 8 de la loi du 6 juillet 1989, cela implique pour le locataire d\u2019obtenir l\u2019accord du bailleur sur le montant du loyer de sous-location qui ne peut exc\u00e9der celui convenu dans le contrat de location principal.&nbsp;<\/p>\n\n\n\n<p>Dans l\u2019hypoth\u00e8se o\u00f9 l\u2019une de ces deux conditions cumulatives ferait d\u00e9faut, la sous-location sera qualifi\u00e9e d\u2019irr\u00e9guli\u00e8re entrainant de fait son inopposabilit\u00e9 au bailleur vis-\u00e0-vis duquel le sous locataire n\u2019est qu\u2019un occupant sans droit ni titre.<\/p>\n\n\n\n<p>Par cons\u00e9quent, le propri\u00e9taire pourrait demander l\u2019expulsion du sous-locataire sans que ce dernier ne puisse pr\u00e9tendre \u00e0 une indemnit\u00e9. La sous-location ill\u00e9gale, pour faire valoir ce que de droit doit \u00eatre&nbsp;<strong>constat\u00e9e par voie d\u2019huissier<\/strong>. Le bailleur adressera par ailleurs \u00e0 son locataire une sommation de respecter les clauses du bail commercial qui les lie.&nbsp;<\/p>\n\n\n\n<p>De plus, la Cour de cassation, dans un arr\u00eat de 3<sup>\u00e8me<\/sup>&nbsp;chambre civile, en date du 13 mars 1991, a instaur\u00e9 une jurisprudence d\u00e9sormais constante selon laquelle la sous-location ill\u00e9gale constitue un motif et l\u00e9gitime et s\u00e9rieux permettant au propri\u00e9taire de refuser \u00e0 son locataire son droit au renouvellement du bail lorsque celui-ci arrivera \u00e0 \u00e9ch\u00e9ance, et ce, sans obligation de lui d\u00e9livrer une mise en demeure.&nbsp;<\/p>\n\n\n\n<p>Aux risques d\u00e9crits ci-dessus de sous-louer un bien sans respecter les conditions de l\u2019article L.145-31, s\u2019ajoutent les probl\u00e9matiques li\u00e9es aux assurances puisqu\u2019en cas d\u2019accident, le locataire ne pourra aucunement obtenir r\u00e9paration de la part de son sous-locataire.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>Dans ce contexte, la question s\u2019est pos\u00e9e de savoir si louer une chambre pour une nuit sur une plateforme de particuliers du type Airbnb pouvait caract\u00e9riser une sous-location&nbsp;?&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>Les dispositions du Code de commerce s\u2019appliquent, en effet, \u00e9galement aux locataires de bail commercial sous-louant leur bien ne serait-ce que pour une courte p\u00e9riode.&nbsp;<\/p>\n\n\n\n<p>Dans un arr\u00eat en date du 12 septembre 2019, la Cour de cassation a confirm\u00e9, \u00e0 ce titre, que le bailleur est en droit de r\u00e9clamer le remboursement des sommes per\u00e7ues par son locataire. Cette jurisprudence \u00e9largit donc les sanctions de la sous-location ill\u00e9gale d\u2019un appartement en meubl\u00e9 de courtes dur\u00e9es et s\u2019inscrit dans une approche favorable aux bailleurs confront\u00e9s aux pratiques ill\u00e9gales de leurs locataires sur Airbnb.
